These Terms of Service are an agreement between you and Face Values Skincare Pty Ltd (ABN 21 685 695 327), trading as Face Values Skincare ("Face Values", "we", "us" and "our"). We operate this store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience (the "Services"). Face Values is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them (these "Terms"), describe your rights and responsibilities when you use the Services. Please read these Terms carefully, as they include important information about your legal rights, including your rights under the Australian Consumer Law and the limits of our liability. By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.

Our products are made for young people, and everyone is welcome to explore our website. To create an account or place an order, you must be 16 or older. If you are under 18, you must have permission from a parent or guardian before creating an account or placing an order.

Some payment methods have their own age requirements. For example, Afterpay is only available to customers aged 18 or older.

To place an order or create an account, you may be asked to provide information such as your email address, billing, payment and shipping information. You confirm that all information you provide is correct, current and complete, and that you have the right to provide it.

You are responsible for keeping your account login details secure and for all activity on your account. You may not transfer, sell or assign your account to any other person.

We have made every effort to provide an accurate representation of our products and services. However, please note that colours or product appearance may differ from how they appear on your screen due to your device type, settings, and configuration.

We do not warrant that the appearance or quality of any products or services purchased will meet your expectations or be exactly as depicted online. All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities offered to any person, region, or jurisdiction on a case-by-case basis.

Our products are intended for cosmetic use only. Individual results may vary. We recommend performing a patch test before first use, particularly if you have sensitive skin or known allergies.

If irritation or an adverse reaction occurs, discontinue use immediately and consult a qualified healthcare professional if necessary.

Product information, including ingredient listings and usage guidance, is provided for general information purposes only and is not medical advice.

When you place an order, you are making an offer to purchase. Face Values Skincare reserves the right to accept or decline your order at its discretion. Your order is not accepted until Face Values Skincare confirms acceptance.

We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as cancellation requests may not be accommodated once an order is accepted. If we do not accept, modify, or cancel an order, we will attempt to notify you via the email, billing address, or phone number provided.

Your purchases are subject to our Returns & Refunds Policy and your rights under applicable consumer laws. Purchases are for personal or household use only and not for commercial resale or export.

All prices are in Australian dollars (AUD) and include GST. Shipping costs are shown and calculated at checkout. Prices, discounts and promotions may change without notice, but the price you pay is the price shown when you place your order, as set out in your order confirmation email.

Each promotion may have its own terms and conditions, and if they conflict with these Terms, the promotion's terms apply. Unless a promotion's terms say otherwise, only one percentage-off promo code can be used per order, and it can be combined with FV+ rewards as set out in our FV+ Added Values Terms & Conditions. Promo codes and FV+ rewards cannot be used on subscription orders.

You agree to provide accurate and up-to-date account, purchase and payment information. You confirm that the payment details you provide are correct and complete, that you are authorised to use the payment method, and that the charges will be honoured.

When you subscribe, you agree to receive the products you've selected at the delivery frequency you choose (every 2, 3 or 4 months) and to be charged automatically for each order using the payment method you provide. Subscription orders receive 10% off the regular price, and new subscribers receive a welcome gift with their first subscription delivery, while stocks last. The welcome gift is limited to one per customer. Promo codes and FV+ rewards cannot be used on subscription orders.

Payment is taken on the day each order is prepared for delivery, and you'll receive an email confirmation each time. You can edit, skip, pause or cancel your subscription at any time through your account, with no minimum term or cancellation fees. Changes need to be made before your next order is processed to apply to that order.

If the price of a subscribed product changes, we'll let you know by email before your next order is charged.

Face Values eGift cards are issued in Australian dollars, in the values shown on our website, and are delivered by email to the recipient address entered at checkout. Please check the recipient's details carefully before you buy, as we can't be responsible for eGift cards sent to an incorrect email address.

eGift cards are valid for three years from the date of purchase, and the expiry date is shown on each card. They can only be redeemed online at facevalues.com.au, and can't be used in stores, with stockists or to buy other eGift cards. Promo codes and FV+ rewards cannot be used to purchase eGift cards.

eGift cards cannot be refunded, exchanged for cash or resold, except where required by law. Any unused balance remains on the card until it expires. If an order paid for with an eGift card is refunded, the refund will be credited back to that eGift card.

Please keep your eGift card code safe and treat it like cash. We can resend an eGift card to the original recipient address, but we're not responsible for lost or stolen codes or for use by anyone who has the code. We may cancel an eGift card if we reasonably believe it was obtained or used fraudulently.

Nothing in this section limits your rights under the Australian Consumer Law.

Face Values donates 1% of net sales to The Embrace Collective, a health promotion charity that teaches body appreciation to young people and supports the adults around them.

For this purpose, "net sales" means the amount customers actually pay for products, after any discounts, promo codes, FV+ rewards and subscription savings are applied, and less any refunds and returns. Net sales exclude GST and shipping charges. eGift card purchases are not counted when the card is bought. Instead, products paid for with an eGift card are counted when the card is spent.

Donations are made by Face Values from its own revenue. They do not add to the price you pay and are not a donation made by you, so they are not tax deductible for customers.

We calculate and pay our donation every quarter. We may change or end this commitment, or support a different charity, at any time. We will update this section and our website before any change takes effect, and a change will not affect donations owed for sales made before that date.

We aim to dispatch orders promptly; however, delivery times are estimates only and not guaranteed. Delays may occur due to shipping carriers or events outside our control. Once dispatched, orders are shipped via a third-party carrier. While we take reasonable care in packaging and dispatching orders, nothing in this section limits your rights under applicable consumer laws.

All trademarks, brands, text, displays, images, graphics, product reviews, video, audio, and the design, selection, and arrangement of the Services are owned by Face Values Skincare, its affiliates, or licensors, and protected by intellectual property laws.

You may use the Services for personal, non-commercial purposes only. You must not reproduce, distribute, modify, create derivative works, display, perform, republish, download, store, or transmit any material without prior written consent. Nothing grants you rights under Face Values Skincare, Shopify, or third-party intellectual property.

Face Values Skincare’s names, logos, product and service names, designs, and slogans are trademarks and must not be used without prior written permission. Shopify’s names, logos, product and service names, designs and slogans are trademarks of Shopify. Other names, logos, products, and services are trademarks of their respective owners.

Access to third-party customer tools is provided “as is” and “as available” without endorsement. We have no liability for your use of these tools. Use is at your own risk and discretion. Ensure you are familiar with third-party terms before using any tools.

Future features and tools are deemed part of the Services and subject to these Terms.

The Services may contain links to third-party websites. We are not responsible for the content or accuracy of third-party materials. Access is at your own risk. Review third-party policies before engaging in transactions. Complaints should be directed to the third party.

Face Values Skincare is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Face Values Skincare. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Face Values Skincare, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Face Values Skincare.

All personal information collected is subject to our Privacy Policy and may also be subject to Shopify’s Privacy Policy. By using the Services, you acknowledge that you have read these policies.

Information submitted is transmitted to Shopify and may be shared with third parties in other countries to provide Services. Review our Privacy Policy for details.

By submitting Feedback, you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display such Feedback for any purpose, including commercial use.

You represent and warrant that you own all rights to Feedback, have disclosed compensation received, and that Feedback complies with these Terms. We are not obliged to maintain confidentiality, pay, or respond to Feedback. Feedback must not violate third-party rights or contain malware. You are responsible for the accuracy and legality of your Feedback.

Information on the Services may contain errors, inaccuracies, or omissions. We reserve the right to correct, update, or cancel information or orders if inaccurate, at any time without prior notice.

You may access and use the Services for lawful purposes only. You may not:

• Use the Services unlawfully, maliciously, or in breach of laws or regulations
• Infringe intellectual property or harass, abuse, insult, defame, or harm others
• Transmit false, misleading, or non-compliant material

Certain sections survive termination, including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and other provisions that by nature survive termination.

Subject to the Australian Consumer Law, information on the Services is for general purposes only. Use is at your own risk. All Services and products are provided “as is” and “as available,” without any representation, warranty, or condition, including merchantability, fitness for purpose, durability, title, or non-infringement. Some jurisdictions limit disclaimers, so this may not apply to you.

To the fullest extent permitted by law, and subject to the Australian Consumer Law, Face Values Skincare, its affiliates, Shopify, and related parties are not liable for any direct, indirect, incidental, punitive, special, or consequential damages arising from your use of the Services or products.

Nothing in these Terms excludes or limits rights under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded. You are entitled to a replacement or refund for major failure and compensation for reasonably foreseeable loss or damage. Goods may also be repaired or replaced if not of acceptable quality, where the failure is not major.

You agree to indemnify, defend, and hold harmless Face Values Skincare, Shopify, and related parties from losses, damages, liabilities, or claims arising from your breach of these Terms, violation of law or third-party rights, or access/use of the Services. We may control defence and settlement at our expense but will not require non-monetary obligations from you without consent.

If any provision is unlawful, void, or unenforceable, it will be severed, and the remaining provisions remain valid and enforceable.

Failure to enforce any right does not constitute a waiver. These Terms, and any policies or operating rules posted by us, constitute the entire agreement, superseding prior agreements or communications.

You may not delegate, transfer or assign this Agreement without our prior written consent. We may transfer or assign our rights and obligations without notice.

These Terms are governed by the laws of Victoria, Australia. You agree to submit to the exclusive jurisdiction of Victoria courts.

Headings are for convenience only and do not affect these Terms.

We may update or replace these Terms at our discretion. Material changes will be notified in accordance with applicable law. Your continued use constitutes acceptance of changes.
